Using this website
By using this website, you agree to use it lawfully and in a way that does not damage the website, interfere with others, attempt unauthorised access, or misuse any content, forms, or systems.
We may update, suspend, or remove any part of the website at any time. We try to keep information accurate, but website content is provided for general information and may change without notice.
Enquiries and proposals
Submitting an enquiry does not create a client relationship or require Flough to accept a project. A project begins only when both parties agree to a written proposal, scope of work, statement of work, or other written agreement.
Unless stated otherwise in a signed agreement, estimates, timelines, availability, and deliverables shared during early discussions are indicative and may change as project requirements become clearer.
Client responsibilities
Clients are responsible for providing accurate information, timely feedback, required approvals, access credentials, brand assets, content, legal notices, and any third-party permissions needed for the work.
Delays in feedback, approvals, payment, or asset delivery may affect schedules, launch dates, and cost.
Intellectual property
Flough retains ownership of pre-existing materials, tools, frameworks, know-how, concepts not selected, and reusable methods developed before or outside a project.
Project-specific ownership, licences, portfolio rights, source files, and transfer terms are governed by the applicable written project agreement. Website content, visuals, code, marks, and other materials may not be copied or reused without permission.
Third-party services
Projects may rely on third-party platforms, hosting providers, payment processors, email services, analytics tools, APIs, plugins, fonts, stock assets, or software libraries. Those services are governed by their own terms and may change independently of Flough.
Liability
To the extent allowed by law, Flough is not liable for indirect, incidental, special, consequential, or loss-of-profit damages arising from use of the website or from third-party services.
Nothing in these terms excludes liability that cannot be excluded under applicable law.
Governing law
These website terms are governed by the laws of South Africa. Any project-specific agreement may include additional or different legal terms.
